Inheritance Consultation

for Women

Understand your Islamic inheritance position and prepare for your will

Islamic inheritance can become complicated when applied to the realities of modern family life. Questions about estranged family members, blended families, joint ownership, debts, bequests and different forms of wealth can leave you unsure about what happens to your wealth and assets after your demise.

An Inheritance Consultation provides personalised guidance on how the Hanafi rules of Islamic inheritance apply to your particular circumstances.

You will gain clarity on who your Islamic heirs are, what their respective shares are, and how your estate is dealt with after death - from funeral and burial expenses, to debts, bequests and finally the distribution of the remaining estate.

You will also have the opportunity to ask questions about your circumstances and understand why the inheritance is distributed in the way that it is.

Most importantly, you will come away knowing your Islamic inheritance position and what information needs to be communicated when preparing your will; whether you intend to use an Australian legal will kit yourself or provide the relevant information to a lawyer who will prepare your will for you.

What you will gain from the consultation
  • A clear understanding of your Islamic inheritance position

  • The identity of your potential Islamic heirs and their respective shares

  • An understanding of how funeral and burial expenses, debts and bequests affect the estate

  • Clarity around waṣiyyah (bequests) and what may be allocated through a bequest

  • Answers to questions arising from your particular family circumstances

  • The information you need to communicate when preparing your will

  • Greater confidence in discussing your Islamic inheritance requirements with a lawyer or completing an Australian legal will kit

Contemporary family circumstances can raise questions that are not always straightforward. For example:

  • Does an estranged child still inherit?

  • What happens when someone has children from more than one marriage?

  • What happens to jointly owned assets?

  • How do debts affect the inheritance?

  • What can you leave to someone who is not an heir?

  • What happens when your parents, spouse or children are involved in different combinations?

  • What happens when your family circumstances are complicated or unusual?

These questions can be considered within the framework of Islamic inheritance law and applied to your individual circumstances.
